The ISI had plotted a stint to malign the President of Pakistan and that is why the Pakistani High Commisioner to Britain was intercepted in Geneva while retrieving documents for the National Acountability Bureau from Swiss attorneys. He was accompanied by Dr. Danishwar Malik of NAB and they were performing a government duty but they were represented as acting criminally by a GEO TV reporter. The following interview of Wajid Shams-ul-Hassan was conducted one day before the Supreme Court decision on NRO..
Ibrahim Sajid Malick (ISM): What were you doing in Geneva?
Wajid Shamsul Hasan (WSH): I was officially assigned by the Pakistan Foreign Office to accompany NAB Prosecutor General Dr Danishwar Malik to Geneva. Dr Danishwar Malik was dispatched from NAB Islamabad to go to Geneva to collect the cartons lying with the Swiss lawyers.
ISM: What documents did you pick up from the attorney and why?
WSH: It was the NAB Prosecutor General who received the closed cartons in my presence and that of Mr. Aftab Khokher, Deputy Permanent Representative at the Pakistan’s Geneva Mission. Since the boxes were closed I do not know the nature of things inside the boxes.
ISM: Why did you not respond to Geo stringer?
WSH: I was intercepted by two hoodlum looking guys in a Geneva street. They did not identify themselves as such and I was not obliged to respond to thug-looking strangers.
ISM: Is it your intent to destroy these documents? If not, can they be used against President Zardari? Are you willing to make them available to Pakistani judicial system?
WSH: Boxes sent in sealed diplomatic bags from Geneva by the Pakistan’s Permanent Representative’s office are in the safe custody of Pakistan High Commission in London. These sealed diplomatic bags containing the boxes were inspected by the NAB Prosecutor General Dr. Danishwar Malik on his arrival in London from Geneva. There was no intent and there is no question of either tampering with them or destroying them. They will be shipped as and when NAB makes arrangements. As regards their
ISM: NAB Chairmain Naveed Ahsan has asked that you send the Swiss court record of cases against President Zardari as soon as possible through diplomatic bag and special courier. Will you comply?
WSH: Yes. Those boxes lying in the Pakistan Embassy in London are NAB’s property. I have requested the NAB authorities to assign Dr Danishwar Malik who brought them here, to come over to London, collect them after inspection and conform if these were subjected to any tampering or foul play as was alleged by a section of Pakistani media. I have requested that either NAB Prosecutor General Dr Danishwar Malik or any person authorized by NAB is sent to London as a special courier to inspect those boxes. Pakistan High Commission will make arrangements accordingly for their shipment in the same sealed diplomatic bags they were sent to London from Deputy Permanent Representative of Pakistan’s Permanent mission in Geneva.
ISM: Did you benefit from NRO? If not, why is your name in the list of NRO beneficiaries?
WSH: I did not benefit from NRO. It was clarified by the Minister of State for Law Mr. Afzal Sindhu, that in his press conference while announcing the list of NRO beneficiaries my name was mentioned inadvertently as a mistaken identity since a name similar to mine was in the list. My position was repeatedly clarified in the media.
However, I regret that despite clarifications a particular group in the media continues to mention my name as a beneficiary although its channel Geo was the first to highlight Law Minister’s clarification. Obviously this could mean there is a sinister method behind this madness. And, the conspiracy to destabilize the democratic government is gaining strength.
ISM: Do you know a gentleman name Naseer Malik in Geneva? Why was he so interested in embarrassing you?
WSH: Most certainly not.
ISM: Why do you think ISI’s Joint Counterintelligence Bureau rep who works within your premises provided your travel information to Geo’s stringer?
WSH: I do not think that any one working in my Mission was involved in ‘leaking’ the information of my travel. Any way my visit was not clandestine or mysterious as everything was on record.
ISM: Why were you framed? Who gains from it?
WSH: I feel that I have been made a victim of a scandalous campaign by Bhutto-haters with the sole objective of targeting President Zardari. By hitting me they think they weaken Mr. Zardari.
ISM: Why do you think Pakistanis who support democracy are muzzled?
WSH: It is a game of lethal perceptions let loose in a section of the media with an agenda of their own to destabilize and derail democracy. Since they could not manage an electoral defeat to keep PPP out of power, they now want democracy to be murdered judicially. This is amply reflected in their comments that whatever the decision of the Supreme Court, the recent ‘disclosures’ by the media shall have to be taken notice of. I am confident that Pakistan’s judiciary has come of age through toughest trial; it won’t play to the media gallery and shall act on merit. President Zardari has been a victim of political vendetta for more than ten years. The pudding of vendetta has been tasted by the Chief Justice himself who was made a similar victim of reference of fabricated charges by President Musharraf. Had there been no change in government General Musharraf would have made him rot in detention. He was brutally maligned by that section of the media who dance to the tunes played by their masters who had supported Musharraf in his action against the Chief Justice.

ISI with the Army is growing stronger and stronger and with this the chances of Democracy surviving is getting weaker and weaker.

Do you know that Pakistani Generals are worth Rs 500 million each (conservative estimate). Pakistani military establishment has systematically looted the country. They are no more than thieves.
In her book Ayesha Siddiqa-Agha has written about Pakistani military business operations. From her experience in working as a civil servant in Pakistan she found out that the Pakistani army has amassed great wealth and that the military has become “predatory engaging in political and economic predation.”
One way its been done is by amassing land. 10 percent of all land, according to the 1912 Colonization of Land Act, is allotted to the military. On paper this land is meant for operational purposes only, but apparently the land has been misappropriated and used as personal land.
Dr. Siddiqa has accused the Pakistan army of running a complete ’side economy’ which includes not just real estate, but also ‘ businesses done by subsidiaries, organizations and individuals.” According to her, this economy could be around 4% of GDP and their share in private sector assets is about 7-10 percent. In crores this is worth about Rs 200 billion and this is not counting the real estate. This is the largest ownership by any single group.

The NRO judgment has struck down the law also for being violative of Article 62(f), which requires a member of parliament to be, ‘Sagacious, righteous and non-profligate and honest and ameen’.
Hence, the bench will now judge the moral standing of parliamentarians on these stringent standards set by the notorious Zia regime. This article of the constitution has always been considered undemocratic and a tool to keep members of parliament insecure.
If parliamentarians, who also go through the rigorous test of contesting elections in the public domain, are to be subjected to such exacting moral standards then the scrutiny of judges should be higher still.
After all, judges are selected purely on the value of their integrity and skills. Judges who erred in the past seek understanding on the plea that they subsequently suffered and have made amends. Should others also not be given the same opportunity to turn over a new leaf? How will sagacity and non-profligate behaviour be judged?

Perhaps the real question I should ask is, why do I even care? When I took time off from Harvard to be part of the lawyers’ movement I had seen a ray of hope. There were concerned citizens and lawyers who stood for what was right, no matter what the consequences. We fought for a principle and won, with the hope that things will slowly improve. Today the very judges we had faith in released the Lal Masjid cleric whose crimes everyone knows about. If the judiciary was going to release people whose crimes were recorded on TV, perhaps it does explain why the Taliban are growing popular.
Having said that, rays of hope like Afzal Khan Lala, who has refused to move from Swat while he is alive, appear every now and then. However, he stands alone in facing the storm. Other than Ayaz Amir, not a single Pakistani leader has spoken out against the Taliban. Will the real leader who can get rid of these monsters stand up, please? Imran Khan? Qazi? Nawaz Sharif? This silence is criminal!

I would just like to comment on the original story. The plot seems very weak and the arguments put forward by Mr. Wajid do not hold water on scrutiny. From an analytical point of view the whole story seems like a very feeble attempt to defend some thing undefendable and he fails miserably.

JUSTICE AND JUDGES DURING MARTIAL LAW REGIME OF PAKISTAN ARMY.
Asif Zardari, husband of former Prime Minister Benazir Bhutto, has waited for more than 5 years for the start of his trial on charges of killing his brother-in-law, Murtaza Bhutto in 1997. In April 1999, Zardari was tried and convicted separately on corruption charges. In December 2001 Zardari received bail but was not released; the NAB ordered his continued detention on suspicion of corruption. Despite government claims that NAB cases would be pursued independent of an individual?s political affiliation, NAB has taken a selective approach to anti-corruption efforts (see Section 1.d.). The Musharraf Government in 1999 created by ordinance the NAB and special accountability courts to try corruption cases (see Section 1.d.). The NAB was created in part to deal with as much as $4 billion (PKR 208 billion) that was estimated to be owed to the country’s banks (all of which were state-owned at the time; several have since been privatized) by debtors, primarily from among the wealthy elite. The Musharraf Government stated that it would not target genuine business failures or small defaulters and does not appear to have done so. The NAB was given broad powers to prosecute corruption cases, and the accountability courts were expected to try such cases within 30 days. As originally promulgated, the ordinance prohibited courts from granting bail and gave the NAB chairman sole power to decide if and when to release detainees. The ordinance also allowed those suspected by the State Bank of Pakistan of defaulting on government loans or of corrupt practices to be detained for 15 days without charge (renewable with judicial concurrence) and, prior to being charged, did not allow access to counsel. In accountability cases, there was a presumption of guilt, and conviction under the ordinance can result in 14 years’ imprisonment, fines, and confiscation of property. The new government’s principal vehicle for detaining former officials and party leaders, however, was the National Accountability Ordinance, a law ostensibly created to bring corrupt officials to account. The ordinance confers sweeping powers of arrest, investigation, and prosecution in a single institution, the National Accountability Bureau (NAB), and permits detainees to be held for up to ninety days without being brought before a court. The law was later amended to facilitate conviction by shifting the burden of proof during trial from the prosecution to the defense.
There were persistent reports of ill treatment in NAB custody, particularly in the case of high profile detainees who were held early in the year in Attock Fort. Persons convicted under the ordinance were prohibited from holding public office for a period of twenty-one years. An amendment to the Political Parties Act in August also barred anyone with a court conviction from holding party office. The combined effect of these acts, as they were applied, was to eliminate the existing leadership of the major political parties. While administration officials said that parties would be allowed to participate in future elections to the Senate and national and provincial assemblies, local government elections, scheduled to be held in December, were to be conducted on a non-party basis.
The Musharraf government also suppressed political activity by conducting raids on party offices, preventing political rallies from being held, and lodging criminal cases against rally organizers under laws governing sedition and the Maintenance of Public Order (MPO) Ordinance. The sedition law, Section 124-A of the Pakistan Penal Code, criminalizes speech that “brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards, the Central or Provincial Government established by law.” Section 16 of the Maintenance of Public Order Ordinance prohibits speech that “causes or is likely to cause fear or alarm to the public” or any section thereof, or which “furthers or is likely to further any activity prejudicial to public safety or the maintenance of public order.”
Rana Sanaullah Khan, a member of the suspended Punjab provincial assembly from Sharif’s Pakistan Muslim League (PML), was arrested in Faisalabad on November 28, 1999. The arrest came after he criticized the army at a meeting of former legislators and urged his colleagues to launch a protest movement against the military government. He was tortured while in custody, and criminal charges were registered against him under the sedition law and MPO .
On March 15, the government formally curtailed freedom of association and assembly with an order banning public rallies, demonstrations, and strikes. The order’s enforcement against a procession from Lahore to Peshawar that Nawaz Sharif’s wife, Kulsoom Nawaz, had planned to lead, resulted in the arrests of at least 165 PML leaders and activists. On September 21 the ban was also invoked against 250 members of the hardline Sunni Muslim group, Sipah-e-Sahaba, who had planned a march to celebrate a religious anniversary. These days every political figure and media is paying tribute to the independent judiciary of Pakistan for its landmark decision on NRO. In this atmosphere of praise for the judiciary some people are asking the highest court of Pakistan, the Supreme Court, to show its power in getting the confiscated portion of main road of Islamabad, Shahrah e Suharwardy, released from a security agency offices located there. This office of the most powerful agency of Pakistan has occupied the main portion of the road near Aabpara in the name of defence against terrorism for the last almost one year. The traffic is unnecessarily diverted from that portion and now the diversions have taken the shape of permanent roads.
Can our highest court, which has even challenged the head of state, show its muscles against these powerful people as well?

The detailed judgment in the case of the restoration of the Chief Justice of Pakistan on July 20, 2007 reveals that not only Pervez Musharraf but the then Director General ISI and the DG Military Intelligence (MI) had also insisted that the chief justice resign during his illegal detention at the Army House Rawalpindi on March 9, 2007.
The judgment, penned by Justice Khalilur Rehman Ramday, says: “The petitioner CJP went on to depose that ‘the respondent (the president) insisted that the deponent (the CJP) should resign’. He added that his refusal to oblige, ‘ignited the fury of the respondent (the president); he (the president) stood up angrily and left the room along with his MS, COS, and the prime minister of Pakistan, saying that others would show evidence to the deponent’ (about the allegations of misconduct against the CJP).”
“As per the CJP, his meeting with the president lasted for about thirty minutes meaning thereby that the president and the prime minister would have left by about 12.15/12.30 pm and the CJP was then left behind in the company only of the DG MI, the DG ISI allegedly to be shown the evidence in support of the above-noticed accusations.
The CJP alleged that no evidence at all was shown to him and “in fact, no official except DG ISI had some documents with him but he also did not show anything to the deponent” (the CJP). He added that they only accused him of having secured a seat for his son in Bolan Medical College while he was serving as a judge of Balochistan High Court. “The CJP further alleged that the DG MI and the DG ISI kept insisting that he should resign from his office while he continued to assert strongly that the allegations were baseless and were being levelled only for a collateral purpose and that he would not resign at any cost and would rather face the said false charges.”
The judgment states, “While the CJP was still at the President’s Camp Office in Rawalpindi during the said crucial ‘FIVE HOURS’ and when according to the CJP he was being detained there against his wishes after 12 noon and when according to the respondents he was sitting there, in the company of the intelligence chiefs examining the reference and the material available in support thereof, a notification dated March 9, 2007, was issued by the Government of Pakistan in the Law, Justice and Human Rights Division mentioning therein that since the President of Pakistan had been pleased to make a reference called a ‘DIRECTION’ by Article 209(5) of the Constitution) to the SJC against the CJP, therefore, the President had restrained Mr Justice Iftikhar Muhammad Chaudhry from acting as the Chief Justice of Pakistan or even as a Judge of the Supreme Court of Pakistan.”
The honourable judges of the Supreme Court also made it clear that the case had nothing to do with army as an institution but acts of a person who happened to be chief of army staff. The judgment regarding the statement of Chaudhry Shujaat Hussain that ‘it was a matter between army and judiciary’ states, “This, in our opinion, was a naive attempt to create a wedge between two important and indispensable arms of the State and to put them on a war-path. What was in question before us was an act of the President and it was just an accident or a coincidence that the said President also happened to be the Chief of Army Staff. The matter had obviously nothing to do with the Army as an institution. Needless to add that the Army was an invaluable organ and instrument of the State and was as precious to us all as any other institution of our homeland. We, therefore, take this opportunity to express our disapproval and displeasure about the said statement.”
Political analysts and observers who had watched the situation at the time, however, told The News that the involvement of junior military officers was minimal and on the specific orders of General Pervez Musharraf who had his own personal vested interest to protect.
They said whatever happened at the time was planned and ordered by General Musharraf and no other army or intelligence officer could be blamed for it. “It was Musharraf and Musharraf alone who must be held responsible for the treatment he meted out to the judiciary and the judges have also noted this in their judgment when they said the army had nothing to do with it as an institution,” an analyst said.
It should be noted that both the ISI and the MI were directly under control of the then COAS, General Musharraf, although the ISI is supposed to be under the prime minister.
A retired general who was closed to General Pervez Musharraf when contacted said that Musharraf tried to show the door to the chief justice because he wanted extension in his tenure that was expiring, election results of his own desire and government of his own choice. He considered the chief justice as the only person who could create hurdles in the achievement of his objectives. He said Musharraf’s stakes were very high and he wanted to achieve his objectives at all costs.
Musharraf, he said, used his senior colleagues, to press the chief justice to quit. He said the then DG MI General Nadeem Ijaz, who was relative of Musharraf, crossed all limits in dealing with the opponents of the former dictator. The DG MI was the strong man of Musharraf. He said Musharraf took aggressive steps against judiciary on the advice of the DG MI, who was in fact responsible for spoiling Musharraf’s all matters related to judiciary. The DG IB went too far in bid to protect the interests of his boss (Musharraf).
He said under Musharraf’s pressure the DG MI Ijaz, DG IB Ejaz Shah, the then secretary interior and some others also submitted affidavits in the Supreme Court against the chief justice. He reminded that the DG ISI did not submit an affidavit. It was believed that Musharraf asked the DG ISI to submit his affidavit but the latter said sorry to the former. Musharraf, he said, was reportedly offended by the DG ISI. He said despite Musharraf’s intensive efforts, the then DG ISI Gen Ashfaq Parvez Kayani kept a reasonable distance from this issue in grace.
He said Gen Kayani was popular as a simple soldier. He did not show any interest in Musharraf’s machinations and that was why he did not submit any affidavit.
Observers are pleasantly surprised that Chief Justice Iftikhar Mohammad Chaudhry wrote the names of military generals including the former DG ISI Gen Kayani, who is present army chief, and the full court also mentioned them in their judgement without showing any fear. They said the chief justice and all the members of the full court deserve praise and esteem for showing rare courage.
Justice Khalilur Rehman Ramday also mentioned the reasons for delay in writing the detailed judgment. The judgment says, “And before I put my pen down, I wish to offer a personal explanation which I owe in connection with this judgment. As is known, the short judgment in the matter was announced on July 20, 2007 and these reasons in support of the said judgment are being recorded after almost 2-1/2 years. This rather extraordinary delay, which was on account of equally extraordinary circumstances, warrants clarification and elucidation.”
He mentioned that after vacations he was a part of a bench hearing the eligibility case of Pervez Musharraf but, when the said matter had almost reached the final stages, martial law (called emergency) was imposed in the country by General Musharraf on November 3, 2007 in his capacity as the Chief of Army Staff. Thirteen out of seventeen Judges were removed from office and some including the Chief Justice were put under house arrest which detention continued till March, 2008. “Thereafter, I was of course a free man but being a ‘REMOVED’ Judge, had no access to the Supreme Court and consequently the entire record of this case, including all the notes, were out of my reach. I, along with the Chief Justice of Pakistan and some other learned brothers, got restored to office in March, 2009 and it is thereafter that I got down to collecting the lost, the forgotten and the scattered threads and this is what I have been able to produce now.”

What ever number of years that he spent in the so called jail was voluntarily as he was too afraid to come out because of his security. Although those who have seen where this hero was “imprisoned”, the atmosphere was always that of a festive with ‘degs’ being cooked each day. Not with standing this, Murtaza was lurking around who had a reach even when in syria. In any case the ‘hero’ had Veena Hayats and the like to take care and that is why he was not pushed for meeting Benazir any time sooner. Further he would have the trial delayed on one pretext or the other. In one of the places he even submitted an affidavit that he was a psychatric patient- so that he could not be punished. Buying a few hardline journalists would be a peanut out of his wealth and that payments too – my gut feelings is -are from the public accounts. Mr Wajid is also poising as a haji and an innocent fellow- then why did he hide himself in london all so long?he wants the law minister sindhu to testify for him. Good one thief to scratch the back of another. Again why was so much eagerness shown to get all those papers? In the drum beat of democracy they have each day immersed themselves to get as much ill gotten money as possible. Such is the chance he and his cronies will never get again. May I ask him whether the hate grows on trees? Is it not the God given ability in an individual to conduct in such a manner that he starts getting hated – which is a fact that atleast 90% educated and comparatively emanciapated individuals do so. Politics makes strange bed fellows. Politics in subcontinent/Indopak means doing wrong again and again, getting worse result each time and expecting a good result from doing wrong next time. Look at neighbor so called Incredible India, which has 330 Million poors that means less than 1 $ per day, if you increase the standard to 2 $, the number will shoot to more than 550 Millions. Mind you, US population is less than 300 Million and Whole EU population is also less than 300 Millions. Plz do not confuse few Indian Billionaires and Indian working in Microsoft/NASA. Plz remember the number of Indian prostitutes in Middle East is on the top and more than the number of summing up all Indian working in various MNCs like Microsoft/NASA/CitiBank.
Democracy in post-colonial states like India/Pakistan means a government off the people, far the people and buy the people. We Pakis/Indian did not take tea, Mr Lipton introduced tea to subcontinent. Alike Politics and democracy were introduced by Mr Humes in subcontinent according to faulty designs in line with our colonial masters interests. Much of our issues dates back to strategic fault lines in our history still unexplained and undisclosed, starting from Sir Syed Ahmed Khan flawed education policy (made by Macaulay), pseudo-leadership/friendly opposition/B Team of Colonial Indopak (Ghandi/Nehru/Jinnah/Liaqat) Creation of Congress by Mr. Humes, Creation of Muslim League on advice of Viceroy. All Congress, ANP and ML were Sarkari tools of establishment from the their start.
Pakistanis is a society composed of deprived/exploited people ruled and governed by few elite coordinating in form of mafias and pressure groups. These are privileged in all walks of life whether Politics, Business, Bureaucracy, Army, Uniform name any institution. They fight between themselves according to their and West larger interest. These mafias and pressure groups have hijacked the whole country for their interest. As result individuals have been deprived from good life and opportunities. This elite was ruling once Capitalist’s and Business Minded Colonials were here and now also when we are free. It is still excellent convergence of interest of our ruling elite and the greatest exploiter of the world known history i.e. Capitalist West. The capitalist system uses two tools for 3rd world countries i.e. first deprivation and then Exploitation. Most importantly our Society has been deprived and exploited in name of Islam continuously, both before and after Indo Pak Partition. This deprivation and then exploitation in our roots is breeding suicides bombers, growing intolerance and violence.
Nothing is complex in life, depending on how you look at it. Present so called fight for Judiciary and Democracy has no nothing to do with poor. President, Ex CJ and Politicians do not represent poor masses, it is the fight of ruling elite for their core interests and power. None has capacity for change or empathy for exploit/deprived masses of Pakistan for last 250 years. It is continuation of East India Company and Colonial period politics and issues through deprivation and exploitation. We will always find blame and wish to rectify 99.99 % poor, helpless deprived and exploited masses. We will always find faults in Slave Son of Slave Son of Slave but never have moral courage to point toward strong and cruel elite backed by Neo-Colonism.
My knowledge is severely limited as I do not move with the high and the mighty. As a ordinary citizen I have just expressed my concerns. Hope they are of some value to you.

Has anyone any doubt about the traitorism of nawaz sharif & zia ul haq one gave up the kargil heights to the indians after the brave mujahid had captured it and the second surrendered siachin to the indians without firing a single bullet shame on both these traitors of pakistan history the mir sadiq n mir jaffar of pakistan
